AMP Personal Data Protection Policy

Information Obligation based on Article 13 GDPR and Article 14 of the General Data Protection Regulation of April 27, 2016, hereinafter referred to as “GDPR”.

Who is the controller of your personal data?

The controller, that is the entity deciding how your personal data will be used, is Paradowscy AMP Sp. z o.o. based in Warsaw at Kazimierza Jagiellończyka 1 (hereinafter “We”, “AMP”, “Paradowscy AMP” or “Company”), a manufacturer of spare parts for internal combustion engines (hereinafter “Paradowscy AMP”).

Where did we get your data from?

We obtained it from you during:

  • The conclusion of a contract between you and Paradowscy AMP;
  • Ordering AMP products via phone, email, mail, or personal contact;
  • Requests for quotations sent by you to us in various forms;
  • Inquiries sent by you through our website www.amp.eu after filling out the contact form;
  • Business or professional contact (if you are an employee of a company cooperating with Paradowscy AMP).

 

What is the purpose and legal basis for the processing of your personal data by Paradowscy AMP?

We process your personal data because it is necessary to perform the contract concluded with you, including:

  • Handling inquiries you direct to us (e.g., via the contact form on the website);
  • Contacting you, including for purposes related to the provision of services;
  • Handling complaints;
  • Fulfilling orders;
  • Contacting you to submit commercial offers.

Additionally, the law requires us to process your data for tax and accounting purposes. We also process your personal data for the purposes listed below, based on the legitimate interest of Paradowscy AMP, which includes:

  • Contacting you, including for permitted marketing activities through available communication channels, especially with your consent via email and phone;
  • Handling your requests, particularly those directed to the user support department and through the contact form when they are not directly related to the performance of the contract;
  • Organizing loyalty programs, contests, and promotional campaigns in which you can participate;
  • Debt collection; conducting court, arbitration, and mediation proceedings;
  • Conducting statistical analyses;
  • Storing data for archiving purposes and ensuring accountability (proving compliance with legal obligations).

You can withdraw your consent for the processing of personal data at any time in the same way you expressed it. We will process your personal data until you withdraw your consent.

 

Do you have to provide us with your personal data?

We require you to provide the following personal data to be able to conclude and perform the contract with you, and thus provide you with a service or respond to your inquiry regarding our activities:

  • Name and Surname
  • Contact phone number (if you consent to phone contact)
  • Email address (if you consent to email contact)
  • Postal address (if you consent to postal contact or in case of concluding contracts and shipping products)

 

If for some reason you do not provide these personal data, unfortunately, we will not be able to conclude a contract with you, and consequently, you will not be able to use the services of Paradowscy AMP.

If required by law, we may require you to provide other data necessary, e.g., for accounting or tax reasons. In addition to these cases, providing your data is voluntary.

 

What are your rights regarding the data processed by the Company?

We guarantee the fulfillment of all your rights under the General Data Protection Regulation, i.e., the right to access, rectify, delete your data, limit its processing, the right to data portability, not to be subject to automated decision-making, including profiling, as well as the right to object to the processing of your personal data.

You can exercise these rights when:

  • Regarding the request to rectify data: you notice that your data is incorrect or incomplete;
  • Regarding the request to delete data: your data will no longer be necessary for the purposes for which it was collected by the Company; you withdraw your consent to data processing; you object to the processing of your data; your data is processed unlawfully; the data should be deleted to fulfill a legal obligation;
  • Regarding the request to limit data processing: you notice that your data is incorrect – you can request the limitation of the processing of your data for a period that allows us to check the accuracy of the data; your data is processed unlawfully, but you do not want it to be deleted; your data is no longer needed by us, but you need it to defend or pursue claims; or you object to the processing of data – until it is determined whether the legitimate grounds on our side override the basis of the objection;
  • Regarding the request for data portability: the processing of your data is based on your consent or a contract concluded with you and when the processing is carried out automatically.

You have the right to lodge a complaint regarding the processing of your personal data by us with a supervisory authority, which is the General Inspector of Personal Data Protection (address: General Inspector of Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

 

To whom do we share your personal data?

Your data is processed only within Paradowscy AMP Sp. z o.o. to perform contracts, orders, prepare commercial offers, and other marketing activities, conduct sales statistics, as well as for accounting and tax documentation purposes. Your data is not shared with third parties except as required by accounting and tax regulations and except for the Information Security Administrator (ABI) and the IT System Administrator (ASI), which ensure the protection of data stored electronically and are entities cooperating with Paradowscy AMP on an outsourcing basis.

 

How long do we store your personal data?

We store your personal data for the duration of the contract concluded with you and also after its termination for the purposes of:

  • Pursuing claims related to the performance of the contract,
  • Fulfilling obligations arising from legal regulations, including tax and accounting,
  • Preventing abuse and fraud,
  • Statistical and archiving purposes.

We store your personal data for marketing purposes for the duration of the contract or until you object to such processing, whichever occurs first.

In the case of organizing loyalty programs, contests, and promotional campaigns in which you can participate – we will process your data for their duration and the period of accounting for the awards. For accountability purposes, i.e., proving compliance with the regulations concerning data processing, we will store data for the period during which Paradowscy AMP Sp. z o.o. is obliged to retain data or documents containing them to document the fulfillment of legal requirements and enable control of their fulfillment by public authorities.

 

Do we transfer your data outside the European Economic Area?

Your personal data will not be transferred outside the European Economic Area.

 

Do we process your personal data automatically (including through profiling) in a way that affects your rights?

Your personal data will not be processed automatically.
